Employer’s Prerogative vs. Employee Privacy in the High-Tech Frontier:  Protecting Your Organization  

Are you exposing your organization to legal jeopardy in 2011?  The information age ushered in a wide array of amazingly productive technologies which make the collection, manipulation and transfer of data more efficient than ever before.  With great power comes great responsibility and, especially in our litigious society, great risk.  Businesses must be ever vigilant of the risks of improper data collection, misuse of data which may have been legitimately obtained, failure to protect data, and the wrongful release of data.  They must also protect against the unauthorized hack-and-release tactics of would be "wikileakers," without forcing daily business processes to grind to screeching a halt.  

Our April 21 program explores these broad themes, with particular focus on certain specific issues:  

  • Use of IT department resources to conduct background investigations and fly-speck social media of current and prospective employees;  
  • Right to fire employees based on social media activity;  
  • Risks posed by "wikileaker" types;  
  • Potential liability for RSA security breach;  
  • Unanticipated risks associated with NFC mobile based wallets; and  
  • Increased exposure to liability for inadvertent breach of foreign laws;   Our program will address these issues and other potential problems which arise from the inadvertent use, or the inappropriate misuse or abuse, of the powerful, information-rich  technologies entrusted to our management and supervision.

Jordan Camenker
Professor, Seminole State College  

Jordan Camenker is a professor of Legal Studies at Seminole State College, where he teaches primarily Business Law and related courses.  Camenker has lectured frequently on privacy law, and in 2010 he developed and taught a class on The Law of Privacy in Public and Private Life, under the auspices of the Art and Phyllis Grindle Honors Institute at the College.  A graduate of the University of Florida College of Law and a long-time Central Florida resident, Camenker is the father of four, the brother of four, and the husband of one.  He lives in Winter Springs with his wife, Kay.
